THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION AND WAIVER OF JURY TRIAL. PLEASE READ IT CAREFULLY BEFORE AGREEING.

These Terms & Conditions (“Terms”) govern your access to and use of The Epic Express website and services. By visiting our website, submitting a booking request, making a reservation, or using our services, you agree to be bound by these Terms.
The Epic Express is owned and operated by Southern Screams, LLC (“Company,” “we,” “us,” or “our”).
If you do not agree with these Terms, please do not use our website or services.
1. Services Overview
The Epic Express provides private group transportation experiences, including but not limited to party bus rentals, event transportation, and customized ride experiences for celebrations and private events.
All services are provided by reservation only and are subject to availability, confirmation, and acceptance by The Epic Express.
1.5 Incorporated Agreements
These Terms incorporate by reference the Liability Waiver signed by Client and passengers prior to service, which governs matters concerning physical use of the transportation service. In the event of any conflict, the signed Waiver shall control with respect to those matters.
2. Eligibility to Book
To book services with The Epic Express, you must:

Be at least 21 years of age

Be legally capable of entering into a binding contract

Accept full responsibility for all passengers in your group
The individual making the booking (“Client”) assumes responsibility for compliance with these Terms by all passengers.
3. Booking Requests & Reservations

Submitting a booking request does not guarantee availability.

Reservations are confirmed only after:

Acceptance by The Epic Express, and
-
Receipt of required payment and/or deposit.

We reserve the right to refuse service at our discretion, including for safety, compliance, or operational reasons.
4. Pricing, Payments & Deposits
A. Pricing
All prices are quoted in U.S. dollars and may be subject to:

Applicable taxes and fees
-
Gratuities (if applicable)
-
Additional time or services beyond the original booking
B. Deposits & Final Payment
-
A non-refundable deposit may be required to secure your reservation.
-
Final payment is typically due prior to the day of service (as specified at booking).

Failure to complete payment may result in cancellation without refund.
C. Payment Methods
Payments are processed securely through third-party payment providers. We do not store full payment card information.
D. Overtime Policy
To ensure a great experience for all guests and groups, The Epic Express operates on a strict schedule. All reservations include a clearly defined rental period beginning at the scheduled departure time, regardless of when passengers board.

Overtime Rate: Groups that exceed their reserved rental period will be charged an overtime fee of $50 per 15 minutes (or any portion thereof), billed automatically to the card on file at the time of booking.

Grace Period: A 5-minute grace window is provided at the end of each reservation. Overtime charges begin after this window closes.

Card Authorization: By completing your booking, you authorize The Epic Express to charge any applicable overtime fees to the payment method on file without additional notice.

Driver Authority: The driver has full authority to notify guests when the reservation period is approaching its end. Continued use of the vehicle beyond the grace period constitutes acceptance of overtime charges.

No Exceptions: Overtime fees are non-negotiable and non-refundable. The Epic Express is not responsible for delays caused by traffic, weather, or guest-directed route changes that result in an extended rental period.
5. Cancellations, Changes & Refunds
A. Client Cancellations

Deposits are non-refundable.

Cancellation policies (including refund eligibility) are based on the timeframe provided at booking.

No refunds will be issued for:

No-shows
-
Late arrivals
-
Early termination of service
-
Violations of these Terms
-
B. Changes
Requests for changes (date, time, duration, route, pickup location) are not guaranteed and may result in additional fees.
C. Company Cancellations
The Epic Express reserves the right to cancel or modify services due to:

Safety or conduct concerns
-
Mechanical issues
-
Weather or road conditions
-
Acts of God
-
Government or law enforcement actions
In such cases, refunds or credits will be handled at our discretion.
6. Passenger Conduct & Rules
For safety and experience quality, the following are strictly enforced:

No more than 13 passengers allowed for any reservation
-
No illegal activity of any kind
-
No weapons, fireworks, or hazardous items
-
No smoking or vaping unless explicitly permitted
-
No standing through sunroofs or emergency exits
-
No disorderly conduct
-
No damage to vehicle interiors or equipment
-
No glass
** For bookings that include guests under the age of 21, the following applies: groups with guests aged 16 and older must have at least one adult aged 21 or older present. Groups with guests under the age of 16 must have adults aged 21 or older make up the majority of the total booking. We reserve the right to refuse service if these requirements are not met at the time of pickup.
The driver and/or staff may terminate the ride immediately without refund if these rules are violated.
7. Alcohol & Substances

Alcohol policies are subject to state and local laws.

No illegal drugs or substances are permitted at any time.

The Epic Express reserves the right to refuse service or terminate a ride if alcohol or substance use creates a safety or legal risk.

The Client assumes full responsibility for passenger behavior related to alcohol consumption.
8. Damage, Cleaning & Additional Fees
The Client is financially responsible for:

Any damage to the vehicle
-
Excessive cleaning (including spills, bodily fluids, or trash)
-
Missing or damaged equipment
Fees may be charged after the event if damage is discovered.
9. Delays, Routes & Timing
-
The Epic Express is not responsible for delays caused by traffic, weather, road closures, or passenger lateness.
-
Service time begins and ends at the scheduled times, regardless of delays caused by the Client or passengers.
-
Additional time beyond the booking may be billed at an hourly or prorated rate.
10. Assumption of Risk & Liability Waiver
By using our services, you voluntarily assume all risks associated with group transportation and event travel, including but not limited to injury, illness, or property damage.
To the fullest extent permitted by law, you agree to release, indemnify, and hold harmless The Epic Express, Southern Screams, LLC, its owners, employees, contractors, and affiliates from any claims arising out of:

Use of our services

Passenger conduct
-
Violations of these Terms
11. Limitation of Liability
In no event shall The Epic Express or Southern Screams, LLC be liable for:

Indirect, incidental, or consequential damages
-
Lost personal property
-
Missed events, venues, or reservations
Our total liability shall not exceed the amount paid for the specific service.
12. Lost or Left Items
The Epic Express is not responsible for items left on the vehicle. We may attempt to assist in recovery but make no guarantees.
13. Photography & Media Release
By participating in services, you grant The Epic Express permission to use photographs or video taken during the experience for marketing, promotional, and social media purposes without any form of compensation, unless you notify us in writing prior to the event.
14. Website Use & Intellectual Property
All website content, including logos, text, graphics, and media, is the property of Southern Screams, LLC and may not be copied, reproduced, or used without written permission.
15. Privacy
Your use of the website is also governed by our Privacy Policy, which outlines how we collect and use personal information.
16. Dispute Resolution & Binding Arbitration
THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION AND WAIVER OF JURY TRIAL.
Any claim or dispute arising out of or relating to your use of our website or services will be resolved solely and exclusively by binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this Agreement. Arbitration will be conducted by the American Arbitration Association ("AAA") under its rules then in effect. The laws of the State of South Carolina shall govern this Agreement and shall be used in any arbitration proceeding. Arbitration shall take place in Charleston County, South Carolina.
To begin an arbitration proceeding, you must send a written letter requesting arbitration and describing your claim to: Southern Screams, LLC c/o Registered Agents Inc., 6650 Rivers Ave, Suite 100, Charleston, SC 29406.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, both parties waive any right to a jury trial. Notwithstanding the foregoing, The Epic Express may bring suit in court to enjoin infringement or other misuse of intellectual property or proprietary rights.
17. Governing Law & Venue
To the extent arbitration does not apply, these Terms shall be governed by the laws of the State of South Carolina, and any legal action shall be brought exclusively in the state or federal courts located in Charleston County, South Carolina. YOU HEREBY WAIVE ANY OBJECTION TO THIS VENUE AND AGREE TO EXCLUSIVE JURISDICTION AND VENUE IN CHARLESTON COUNTY, SOUTH CAROLINA.
18. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Continued use of the website or services constitutes acceptance of the updated Terms.
